M-Oceans (“we”, “our”, “us”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your data when you visit our website, create an account, or purchase our products and services.

  • Payment information: payment card details (processed securely through Shopify Payments, PayPal, or other trusted payment providers; we do not store full payment data).

  • Optional information: information you provide voluntarily, such as when subscribing to newsletters, completing surveys, or contacting customer support.
  • Financing information: if you choose to apply for financing, the information needed to prepare your application, which may include financial and employment details. This is used only to facilitate your application with our financing partner.

  • To communicate with you regarding your purchases, account, and customer service inquiries.

2a. Marketing Communications

Marketing communications (CASL). In accordance with Canada's Anti-Spam Legislation (CASL), we send commercial electronic messages, such as promotional emails, only with your consent. Every message identifies M-Oceans as the sender and includes a working unsubscribe link. You can withdraw your consent at any time using that link or by contacting us, and we will action your request promptly.


3. Consent

By providing personal information, you consent to its collection, use, and disclosure as described in this Policy.

You may withdraw consent at any time by contacting us (see Section 11 – Contact Information). However, withdrawing consent may affect our ability to provide certain services.


4. Disclosure of Information

We do not sell or rent your personal information. We may share your data with:

  • Service providers: including Shopify, payment processors, logistics and shipping companies, email and marketing providers, and analytics and advertising providers such as Google and Hotjar.
  • Legal authorities: when required by Canadian law, regulation, or court order.
  • Business transfers: in the event of a merger, acquisition, or sale of assets, your data may be transferred as part of the business.
  • Financing partner: if you apply for financing, the information needed for your application is shared with POSPRO Financial, the third-party brokerage that processes M-Oceans financing applications. POSPRO may share that information with its network of lenders to assess your application, and its use of your data is governed by its own privacy policy.

All third parties are required to maintain the confidentiality and security of your information.


5. Data Storage and Security

Your personal data is securely stored on Shopify's encrypted servers and other trusted third-party systems.

We use appropriate technical and organizational safeguards – including encryption, access controls, and secure storage – to protect your data.

Please note that no method of data transmission or electronic storage is completely secure, and we cannot guarantee absolute protection.


6. Your Rights Under Canadian Law

As a Canadian resident, you have the right to:

  • Request access to the personal information we hold about you.
  • Request correction of inaccurate or incomplete data.
  • Withdraw consent for certain uses of your information.
  • File a complaint with the Office of the Privacy Commissioner of Canada (OPC) if you believe your privacy rights have been violated.

We may require identity verification before processing certain requests for security reasons.


7. Cookies and Tracking Technologies

Our website uses cookies and similar technologies to operate the store, understand how visitors use the site, and measure and improve our marketing. The main technologies we rely on are:

  • Google Analytics 4 (GA4): measures site traffic and how visitors navigate and use the website.
  • Hotjar: collects usage data such as clicks, scrolling, and on-page behaviour through heatmaps and session recordings, to help us understand how the site is used and improve it.
  • Google advertising and conversion tracking: through Shopify's Google & YouTube sales channel, Google measurement and remarketing technologies may set cookies to track conversions and show you relevant ads across Google and YouTube properties.

You can manage or refuse cookies through your browser settings. Most browsers let you block or delete cookies, though some features of the website may not function properly as a result.

Some of the service providers we work with, including Shopify, Google, and Hotjar, store or process data on servers located outside Canada, including in the United States, where privacy laws may differ from those in Canada. Where personal information is transferred or processed outside Canada, it may be accessible to courts and authorities in those jurisdictions, and we take reasonable steps to ensure it remains protected.
